Thompkins bail reduced in rape case
A district court judge granted a bail reduction for Damarcus Thompkins in a sexual intercourse without consent case.
Thompkins, 19, was arrested in February on new charges for harboring a 15-year-old runaway while he was out on bond in the 2025 rape case. His conditions of release prohibited him from being within 1,000 feet of minors.
In February, a judge set his bail at $100,000 since he violated his conditions with another underage girl.
During a July 29 bail hearing, Vince van der Hagen, representing Thompkins, asked that his bail be reduced to $10,000 because he had limited means.
Thompkins accused of harboring, having sex with teen runaways
Thompkins said that before his arrest, he was employed at Jimmy John’s and Texas Roadhouse.
If he’s released, Thompkins won’t be able to live with or be around anyone under 18, under his conditions of release.
Van der Hagen told the court that the C.M. Russell High School graduate has community ties and family living in the area.
“He knows the community, this is home,” van der Hagen said.
Ann Marie McKittrick, the deputy county attorney prosecuting the case, said that Thompkins had harbored a 15-year-old girl, knowing there was an extensive community search for her and he was prohibited from contact with minors.
She said the prosecution dismissed that custodial interference without prejudice because there’s another charge under investigation involving the same victim in that case that occurred during a similar time period.
McKittrick said in court, and wrote in her motion to dismiss, that the prosecution is awaiting analysis of DNA evidence from the Montana State Crime Lab before filing the second charge, but the lab indicated that analysis may not be completed until December.

She said her office considered filing those charges separately but decided to wait until the crime lab analysis is complete, then proceed with both charges at the same time, depending on the results, or refile the custodial interference charge.
During the July 29 hearing, McKittrick said that Thompkins had already proven he wouldn’t follow court orders.
She said she was meeting that afternoon with the mother of one of his victims regarding plea negotiations in that case.
She said Thompkins was a danger to other young girls in the community based on his past behavior.
Van der Hagen said he hoped the crime lab would have results sooner than December in Thompkins’ other case and that the plea offer in the other case was for probation.
Judge denies bail reduction for Riggin based on new allegations
He said he understood the prosecution’s concern and that Thompkins was “strongly warned not to have any contact with minors.”
Van der Hagen said that Thompkins would be the one paying the price of the high bond.
McKittrick said the one who will pay the price is other minors in the community.
Judge John Parker said that the dismissed case remained relevant on the issues before him and that the prosecution’s argument raised “dramatic concerns” about Thompkins’ compliance with court conditions, who “couldn’t really have a more flagrant disregard for the court conditions.”
Parker said that, accounting for Thompkins’ young age and the facts of the case, he would reduce the bond to $40,000 in the interest of protecting the community and concerning the allegation of his non-compliance with conditions.
As of July 31, Thompkins remained in the Cascade County Adult Detention Center.
Plea agreement signed in felony sex abuse of children case
According to court documents, Great Falls Police officers responded Feb. 6 to a mother’s report of a runaway and missing juvenile.
The juvenile’s mother told officers that her daughter had left a note indicating she was leaving to live with a friend in Sun Prairie and was entered into the law enforcement system as a runway/missing person.
On Feb. 11, the GFPD issued an alert that the girl had been last seen at her home on Feb. 6 and might be trying to get to Washington.
Midence charged with PFMA while on bail in felony case
Through their investigation, GFPD detectives found that the missing girl was using Snapchat and other electronic means of communicating with others.
Detectives determined that she hadn’t left the state and was staying at The Grizzly Inn at 1214 13th St. S., where she was located.
The runaway was found in a room being rented by Thompkins, who told detectives she had contacted him asking for a place to stay.
He told detectives that he agreed to house her, called an Uber and picked her up from her home, according to court documents.
Thompkins told detectives that he knew the girl was 15 and running away from home, and that he had seen online posts about her being reported as missing.

At the time, Thompkins had a pending sexual intercourse without consent case and was not to be within 1,500 feet of any minors. That case remains pending.
During a Feb. 18 hearing, Claire Lettow, appeared for Thompkins in his initial appearance and asked District Court Judge Dave Grubich to set bond at no more than $10,000 since he had limited means and was residing at the Grizzly Inn.

Theresa Diekhans, a Cascade County deputy attorney, said that their office requested the high bail, which isn’t typical for the custodial interference charge, due to his recent criminal history involving minors and because he was under court orders not to have contact with minors at the time of the most recent incident.
“This is his pattern that actually goes back to his juvenile days that is extremely concerning,” Diekhans said.
She said the state was concerned about the safety of minor girls who all appear to be runaways and highly susceptible young teenagers.

Grubich said that the court had concerns about compliance since Thompkins was on bail, knowing he was restricted from contact with underage girls at the time of the most recent incident.
Grubich set bail at $100,000 and ordered that Thompkins stay away from the girl in the most recent case and be placed on GPS monitoring prior to release.
Previously, he bonded out and was revoked on previous pending cases, according to prosecutors.
He now has three pending cases in district court, all involving juvenile girls, including the dismissed charge that remains under investigation and will likely be refiled.

In October, Thompkins was charged with a felony count of sexual intercourse without consent and a misdemeanor count of obstructing justice.
In that case, GFPD officers responded to a report of a 14-year-old female runaway.
The girl’s father reported that she had run away and was concerned she was involved with Thompkins, who was 19 at the time.
The officer went to Chili’s, where Thompkins worked at the time, to locate the 14-year-old runaway.
When a GFPD officer spoke to Thompkins, he said that he knew the girl but didn’t know where she was and didn’t have contact with her, according to court documents.

At the time, Thompkins wasn’t supposed to have contact with minors as a bond condition on a previous charge of sexual intercourse without consent for allegedly having sex with a different 14-year-old girl.
In the October case, officers learned the runaway teenage girl had returned home and told investigators that she’d been in contact with Thompkins via Snapchat and Instagram for several weeks. She told investigators that she was supposed to meet Thompkins at the Grizzly Inn, but he’d changed his mind, so she went to Chili’s to see him and that’s where he hid her from officers attempting to locate her there, according to charging documents.
The girl went to Benefis Health System for a sexual assault examination and told officers that she had sex with Thompkins in the backroom of Chili’s, in what was called “the wedding room,” according to court documents.

In September 2025, Thompkins was charged with a felony count of sexual intercourse without consent for allegations of having sex with a 14-year-old girl in Horizon Heights and Jaycee parks. At the time, Thompkins was 18.
In that case, a resident called dispatch regarding two people trying to cover themselves with a blanket in Horizon Heights Park around 7:20 a.m. Aug. 25.
Officers responded and the pair said they were watching the sunrise, according to court documents.
Around 7:30 a.m. Sept. 2, a witness reported two people having sex on the playground at Jaycee Park.
Police again responded, noting that Thompkins was 18 and the girl was 14. She told officers that they were kissing and all over each other, according to court documents. Thompkins denied having sex with the girl.
On Sept. 7, the girl’s mother called police after finding two cell phones her daughter had used containing messages between the girl and Thompkins discussing them having sex and the girl told officers that she had sex with Thompkins, according to court documents.
On Sept. 11, the girl underwent a forensic interview, during which she said that Thompkins knew her age and that they’d talked about how he could get in trouble.
She told investigators that the first time she had sex with Thompkins was at the county fairgrounds in the stadium while it was empty and they were watching the sunset.
The 14-year-old told investigators that she’d had sex with Thompkins about seven times, most of which happened at Horizon Park, according to court documents.

On Sept. 12, officers contacted a witness who’d reported one of the incidents and provided a video recording of one of the sexual encounters.
Officers later interviewed Thompkins at the GFPD, during which he agreed to speak to them without an attorney and admitted to having sex with the 14-year-old girl on multiple occasions, according to court documents.
He told investigators that the first time was at the fairgrounds during the fair, then Horizon Park and also at Jaycee Park.
Thompkins admitted to investigators that he knew the girl was in the 9th grade and not 16, the age to consent to sex in Montana , according to court documents.
