Andrade homicide case continuing, sentencing scheduled in criminal mischief case

Charlotte Andrade had a status hearing in district court March 4 for her deliberate homicide case.

She reportedly terminated her private attorney and Judge David Grubich asked the Montana Office of the State Public Defender whether new counsel could be assigned.

Roger Renville of OPD said that if Andrade agreed, Vince van der Hagen, who was representing her previously, could be assigned.

Judge John Parker said “we have to get put the train back on the tracks,” in terms of scheduling in the case.

Andrade takes plea deal in May incident, homicide case pending

Van der Hagen said he’d essentially be starting the case from scratch.

Parker said the case likely wouldn’t go to trial this year.

Andrade remains in custody on a $1 million bond facing felony counts of deliberate homicide and attempted deliberate homicide from a June 2025 shooting.

In January, she entered a guilty by Alford plea before Judge David Grubich to charges of criminal endangerment and criminal mischief from a May 2025 incident.

An Alford plea is a defendant acknowledging there’s enough evidence to convict but not admitting to the facts. It carries the same significance in sentencing as a guilty plea.

The recommended sentence in the plea agreement is a three year commitment to the Montana Department of Corrections on the criminal endangerment charge and six months in the county jail plus restitution on the criminal mischief charge.

An anger management is recommended for both counts.

The court is not bound by the agreement and can impose a sentence other than the recommendations.

Sentencing in that case is currently set for March 18.

During the Jan. 15 hearing, Andrade and her attorney, Michael Kuntz, said they didn’t agree with the facts of the incident presented by the prosecution but believed the evidence would be sufficient for a jury to convict her.

Grubich accepted her plea and ordered a pre-sentence investigation for sentencing in the case that will be set at a later date, typically six to eight weeks.

There was a warrant for Andrade’s arrest on the charges in the criminal endangerment case when she was arrested and charged in June 2025 with the felony counts of deliberate homicide and attempted deliberate homicide for a shooting at the Phoenix Apartments.

In the May case, Andrade and two males approached a victim on foot while she was at the gas pump, according to court documents.

Andrade told the victim and her friends to leave and a verbal argument ensued, with the victim and her friends getting into her vehicle to leave, but the victim got back out and continued the argument, according to court documents.

Andrade allegedly pulled out a BB gun and shot at the victim’s vehicle twice, causing damage, then pointed it at the victim’s face from four or five feet away and shot the victim in the face, according to charging documents.

She’s accused of shooting two people at the Phoenix Apartments in June, killing one and injuring the other.

Andrade was charged with accountability to deliberate homicide in 2023 in connection with the stabbing death of Tammey McWilliams, 51, near Chowen Springs Park.

A jury found her not guilty in 2024.
